TERMS OF SALES

These conditions of sale are concluded on the one hand by the company LA BOUTIQUE DE BICHETTE whose registered office is located at 86 avenue de Lyon 01960 PERONNAS (FRANCE), SIRET 947 849 600 000 12, represented by Mrs GARCIA Justine, self- entrepreneur, hereinafter referred to as "LA BOUTIQUE DE BICHETTE" and managing the site www.laboutiquedebichette.fr and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.laboutiquedebichette.fr referred to herein - after "CUSTOMER". Email: laboutiquedebichette@gmail.com. VAT not applicable (article 293B of the CGI). 

 

Article 1: object 

These conditions of sale aim to define the contractual relationship between LA BOUTIQUE DE BICHETTE and the CUSTOMER and the conditions applicable to any purchase made through the website www.laboutiquedebichette.fr. The acquisition of a product through this site implies unreserved acceptance by the CUSTOMER of these conditions of sale which he acknowledges having read prior to his order. Before any transaction, the CUSTOMER declares on the one hand that the purchase of products on the site www.laboutiquedebichette.fr is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have the full capacity legal, allowing it to engage under these general conditions of sale. 

The company LA BOUTIQUE DE BICHETTE retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

 

Article 2. Products 

The products offered are those which appear on the website www.laboutiquedebichette.fr of the company LA BOUTIQUE DE BICHETTE within the limits of available stocks. LA BOUTIQUE DE BICHETTE reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description containing its main technical characteristics (capacity, use, composition, etc.). The photographs are as faithful as possible but are not contractual. Article 3. Rates 

The prices appearing on the product sheets of the internet catalog are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the price of the products. LA BOUTIQUE DE BICHETTE reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the CLIENT. 

 

Article 4. Shipping costs

The prices indicated do not include delivery costs and service costs, invoiced in addition to the price of the products purchased according to the total amount of the order. In mainland France, for any order greater than or equal to 100 euros including tax, shipping costs are free; for any order of less than 100 euros including tax, a lump sum contribution to shipping costs will be invoiced to the buyer for a variable amount depending on the weight. These costs are indicated before payment of the order. They are calculated on the basis of the current prices of the Colissimo service.

LA BOUTIQUE DE BICHETTE reserves the right to modify shipping and service charges either by lowering or increasing them.

Return costs are the responsibility of the buyer. 

 

Article 5. Order and terms of payment 

Before any order, the CUSTOMER must create an account on the site www.laboutiquedebichette.fr. The account creation section is accessible directly from the home page. At each visit, the CUSTOMER, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information. 

The company LA BOUTIQUE DE BICHETTE offers the CUSTOMER the possibility of ordering and paying for its products by credit card via the secure payment method “Stripe” or by gift card (purchasable directly on the website www.laboutiquedebichette.fr).

The CUSTOMER adds the products he wishes to order to the basket, modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the CLIENT. Then, the CUSTOMER chooses the method of payment of his choice. Payment by credit card is irrevocable. In the event of fraudulent use of the latter, the CUSTOMER may demand the cancellation of payment by card, the sums paid will then be recredited or returned. The responsibility of the holder of a credit card is not engaged if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contact their bank as soon as possible.

The confirmation of an order entails acceptance of these conditions of sale, the recognition of having perfect knowledge of them and the renunciation of availing oneself of its own conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the CUSTOMER has an e-mail address and if he has entered it on his order form, the company LA BOUTIQUE DE BICHETTE will communicate to him by e-mail the confirmation of the registration of his order.

Article 6. Retention of title 

LA BOUTIQUE DE BICHETTE retains full ownership of the products sold until full payment of the price, including costs and taxes.

 

Article 7. Withdrawal 

Under the provisions of the Consumer Code, the CLIENT has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to LA BOUTIQUE DE BICHETTE for exchange or refund. subject to the condition of the product concerned and the circumstances. The CUSTOMER may exercise his right of withdrawal by sending his wish to withdraw by email to laboutiquedebichette@gmail.com.

The item(s) of the order must be returned according to the indications of LA BOUTIQUE DE BICHETTE contained in the acknowledgment of receipt sent by email. Only products returned as a whole will be taken back, in their complete and intact original packaging, and in perfect condition for resale. The return must be made within 14 calendar days following the communication of the right of withdrawal to the address indicated below:

Return costs are the responsibility of the CUSTOMER. LA BOUTIQUE DE BICHETTE will reimburse the CUSTOMER for all sums paid on the order within 14 calendar days of receipt of all the products concerned. The CUSTOMER will be reimbursed by the same method of payment as the one he used at the time of the order, unless the CUSTOMER expressly agrees that LA BOUTIQUE DE BICHETTE uses another means of payment and insofar as the reimbursement does not cause no costs for the CUSTOMER. The CUSTOMER may, if he wishes, opt, on the proposal of LA BOUTIQUE DE BICHETTE, for another method of reimbursement, in particular in the form of a check or by bank transfer. 

If the conditions mentioned above are not met, LA BOUTIQUE DE BICHETTE reserves the right to refuse the CUSTOMER's package and/or refund. In the latter case, the package will be returned at the CLIENT's expense. In case of return of the products outside the aforementioned period, the CUSTOMER will not be reimbursed and will be informed that the products remain at his disposal for a period of 2 months. During this period, at the CLIENT's request, the products may also be sent back to him at his expense. After this period, the products are kept by LA BOUTIQUE DE BICHETTE with no obligation to reimburse the CUSTOMER.

 

Article 8. Shipping, delivery and delays 

Except during periods of closure of the online store which will be clearly announced on the home page of the site, the shipping times will be, within the limits of available stocks, those indicated below. For online payments, the order is executed within 5 to 7 working days after confirmation of payment by the bank of LA BOUTIQUE DE BICHETTE. For delivery in mainland France, the deadline is a maximum of 7 working days from the day of execution of the order. In the event of a delay in dispatch (force majeure), LA BOUTIQUE DE BICHETTE will contact the CUSTOMER directly to inform him of the new deadline. Shipments are made via the Colissimo home service only.

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Delivery times are only given as an indication; if these exceed thirty days from the order, the sales contract may be terminated and the CUSTOMER refunded. LA BOUTIQUE DE BICHETTE is not responsible for delivery delays attributed to the deliverers or in the event of loss or damage to the package. In these cases, you will need  to contact the Colissimo delivery company directly with the order tracking number sent by email.

The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of LA BOUTIQUE DE BICHETTE. The buyer is required to check, in the presence of the La Poste employee or the deliverer, the condition of the packaging of the goods and its contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

An electronic invoice is available on the CLIENT's personal account and a packing slip is placed in the package.

When the CUSTOMER indicates a delivery address to a third party, LA BOUTIQUE DE BICHETTE assumes that he has obtained the consent of the person concerned and declines all responsibility in the event of a dispute. Any product returned to LA BOUTIQUE DE BICHETTE because of a Incorrect or incomplete delivery address will be reshipped at the CLIENT's expense or, without a response from the CLIENT, will be cancelled.

Delivery charges and service charges are applied to all orders. Their amount is calculated after validation of the basket, on the “payment” page. Order returns are the responsibility of the CUSTOMER and LA BOUTIQUE DE BICHETTE reserves the right to refuse reimbursement depending on the condition of the returned products and the reasons for return. 

 

Article 9. Delivery errors

To benefit from the guarantee or inform of a delivery error, the CUSTOMER must have the order number and the reference of the article concerned (this information is indicated on the order confirmation and the purchase invoice) and will send his request by email using our form accessible from the "CONTACT" tab or by writing to the email address laboutiquedebichette@gmail.com or by mail by writing to the address: 86 avenue de Lyon 01960 PERONNAS.
In order to ensure rapid and quality processing of the warranty claim, the CUSTOMER will specify his contact details, his order number and the reference of the article concerned and will detail as much as possible the problem encountered and, as far as possible, will join to the mail a photograph or several photographs of the defect of the product. Upon receipt of this request, LA BOUTIQUE DE BICHETTE will contact the CUSTOMER within 3 working days to indicate the procedure to be followed.

In the event of a delivery error or the application of the legal guarantees, any product to be exchanged or refunded must be returned according to the indications given by LA BOUTIQUE DE BICHETTE as a whole and in its original packaging.

 

Article 10. Warranty 

All products supplied by the company LA BOUTIQUE DE BICHETTE benefit from the legal guarantee provided for in articles L. 211-4 to L. 211-13 of the Consumer Code and the legal guarantee against hidden defects provided for in articles 1641 to 1648 of the Civil Code. In the event of non-compliance of a product sold, it may be returned to LA BOUTIQUE DE BICHETTE, which will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made electronically to the following address: laboutiquedebichette@gmail.com, within fourteen days of delivery.

 

Article 11. Liability 

The company LA BOUTIQUE DE BICHETTE in the process of distance selling, is bound only by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

 

Article 12. Intellectual Property 

All elements of the www.laboutiquedebichette.fr website are and remain the exclusive intellectual property of LA BOUTIQUE DE BICHETTE. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.

Article 13. Personal data

In accordance with the provisions of the law known as "Informatique et Libertés" of January 6, 1978 and the general data protection regulations of April 27, 2016, the processing of personal data communicated by the CLIENT is justified by the execution of the service delivery contract.

LA BOUTIQUE DE BICHETTE, as data controller, implements the processing of personal data whose main purposes are the management of the CLIENT's registration on the website and the management of the order. The personal data communicated by the CLIENT will be transmitted to Wix and its subcontractors as part of the hosting and editing of the website www.laboutiquedebichette.fr. For the management of the order, the data collected is transmitted to Wix and its subcontractors. As part of the delivery, the personal data indicated by the CLIENT will be communicated to the carriers, according to the delivery methods chosen by him when ordering. The retention of personal data held by the subcontractors of LA BOUTIQUE DE BICHETTE is limited to the duration of the execution of the missions entrusted and to the duration of the applicable legal prescriptions, i.e. generally 3 years after the end of the contract or the last interaction with the company LA BOUTIQUE DE BICHETTE. The CUSTOMER and/or the person concerned by the personal data communicated to LA BOUTIQUE DE BICHETTE or one of its subcontractors within the framework of the execution of this contract has a right of access, interrogation and rectification. which allow them, where applicable, to have any personal data concerning them rectified, completed, updated, blocked or erased which is inaccurate, incomplete, ambiguous, outdated or whose collection, use, communication or storage is illicit. The CUSTOMER can access his information and modify or delete it from his personal account without justifying any reason and at any time.

The CUSTOMER also has the right to oppose the processing of his data for legitimate reasons. The CUSTOMER is informed that this opposition prevents the execution of the order and will imply its cancellation, without being able to engage the responsibility of LA BOUTIQUE DE BICHETTE.
